These Terms & Conditions (“Terms”) govern your use of the website futuresmiles.com.au (the “Website”) and the services provided by Future Smiles Pty Ltd (ABN available on request) (“Future Smiles”, “we”, “us”, “our”).

By accessing the Website, completing our eligibility quiz, requesting an assessment, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, please do not use the Website or our services.

Future Smiles is a lead generation and referral service. We connect people who may benefit from dental treatment with independent, AHPRA-registered partner dental clinics in Melbourne and Greater Melbourne.

Importantly:

• We do not provide dental, medical or health services, advice, diagnosis or treatment. Nothing on the Website or provided by our team is a substitute for professional advice from a qualified, AHPRA-registered dentist.
• We do not perform treatments. All consultations, assessments, diagnoses and treatments are carried out by independent partner clinics, who are solely responsible for the services they provide.
• We have no financial interest in which clinic you choose, and we do not control the clinical judgement, pricing, availability or conduct of any partner clinic.

Our services are intended for people aged 18 and over who are located in Australia. By using our services you confirm that you meet these requirements and that the information you provide is true and accurate to the best of your knowledge.

Our eligibility quiz is an informal, preliminary tool designed to help understand your goals and circumstances. It does not constitute a clinical assessment, diagnosis, or any guarantee that you are suitable for any particular treatment.

Whether you are a suitable candidate for dental implants or any other treatment can only be determined by a qualified, AHPRA-registered dentist following an in-person examination and appropriate imaging. Not all patients are suitable for treatment.

References to a free or complimentary consultation, 3D imaging (CBCT scan) and/or treatment plan (described as worth $1,000 or more) relate to services offered by participating partner clinics. This offer:

• Is subject to eligibility, clinic availability and the terms set by the participating clinic;
• May be varied, limited or withdrawn at any time; and
• Does not include the cost of any treatment you subsequently decide to undertake.

Any pricing, payment plans, financing or superannuation information referred to on the Website or by our team is general information only.

• Financing is provided by third-party providers and is subject to their approval, terms and conditions.
• Early access to superannuation for dental treatment is subject to eligibility under the relevant superannuation legislation and your fund's rules, and is determined by the ATO and/or your fund — not by Future Smiles. You should obtain independent financial and tax advice before accessing your superannuation.

We do not provide financial product advice.

Results vary and individual outcomes are not guaranteed. Any patient stories, examples or descriptions of results on the Website are illustrative only and are not testimonials, unless expressly stated otherwise. They do not represent a promise or prediction about your own results.

When using our services you agree to:

• Provide accurate, current and complete information;
• Use the Website and our services only for lawful purposes; and
• Not interfere with or disrupt the Website, attempt to gain unauthorised access to our systems, or use the Website in any way that could damage or impair it.

By submitting your details, you consent to being contacted by Future Smiles and by a partner clinic by phone, SMS and email in relation to your enquiry and our services. You can opt out of marketing communications at any time as described in our Privacy Policy.

Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms. Please read it to understand how we collect, use, disclose and protect your information.

All content on the Website — including text, graphics, logos, images and design — is owned by or licensed to Future Smiles and is protected by intellectual property laws. You may not copy, reproduce, modify or distribute any content without our prior written consent.

The Website may contain links to third-party websites, and our service involves referrals to independent partner clinics. We are not responsible for the content, conduct, services, products or privacy practices of any third party. Any dealings you have with a partner clinic are solely between you and that clinic.

To the maximum extent permitted by law:

• The Website and our services are provided “as is” and “as available”, without warranties of any kind.
• We do not warrant that the Website will be uninterrupted, error-free, or free of harmful components, or that any information on it is complete or current.
• We are not liable for any loss, damage, cost or expense arising from your use of the Website, our services, or your dealings with any partner clinic or third-party provider.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.

We may update these Terms from time to time. The current version will always be available on the Website, and the “Last updated” date will reflect the most recent changes. Your continued use of the Website after changes are posted constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
